Terms of Use
The agreement between you and SAY IT Labs covering the Pippo Phonics app, your subscription and your rights as a consumer.

These Terms of Use (“Terms”) form a legal agreement between you and SAY IT Labs, BV (“SAY IT Labs”, “we”, “our”, or “us”), a company established in Belgium, governing your use of the Pippo Phonics mobile application (the “App”).
By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App and delete it from your device.
Pippo Phonics is designed for children
These Terms must be accepted by a parent, legal guardian, or other responsible adult, who agrees to them on behalf of the child using the App and accepts responsibility for the child’s use.
1. License grant
Subject to these Terms, SAY IT Labs grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the App for personal, non-commercial purposes on any Apple-branded device that you own or control, as permitted by the Apple Media Services Terms and Conditions.
This license does not permit you to install or use the App on a device you do not own or control, or to make the App available over a network where it could be used by multiple devices at once, except as expressly permitted by Apple’s Usage Rules.
2. Restrictions
You may not:
copy, modify, translate, or create derivative works of the App;
reverse engineer, decompile, or disassemble the App, or attempt to derive its source code or the models underlying its speech recognition, except to the extent this restriction is prohibited by applicable law;
rent, lease, lend, sell, sublicense, distribute, or otherwise transfer the App or your license to it;
remove or obscure any copyright, trademark, or other proprietary notices;
circumvent, disable, or interfere with security features, the parental gate, or any subscription or entitlement mechanism;
use the App for any unlawful purpose or in violation of these Terms.
3. Intellectual property
The App and all content within it, including software, speech recognition technology and models, curriculum and phonics content, characters, artwork, audio, and trademarks, are owned by SAY IT Labs or its licensors and are protected by copyright and other intellectual property laws. These Terms grant you a license to use the App; they do not transfer ownership of anything.
4. Subscriptions and payment
4.1 Purchases are made through Apple
The App may offer optional auto-renewable subscriptions that unlock additional content and activities. All purchases are processed by Apple through the App Store. SAY IT Labs does not collect, process, or store your payment details. Payment is charged to your Apple ID account at confirmation of purchase.
4.2 Subscription terms
The title, duration, and price of each available subscription are displayed in the App on the purchase screen before you buy, and prices are shown in your local currency as set by the App Store.
Subscriptions renew automatically. Your Apple ID account is charged for renewal within 24 hours prior to the end of the current period, at the price of the plan you selected, unless auto-renewal is turned off beforehand.
4.3 Free trials
Where a free trial is offered, any unused portion of a trial period is forfeited when you purchase a subscription. Unless cancelled at least 24 hours before the trial ends, the trial converts automatically into a paid subscription and your Apple ID is charged.
4.4 Managing and cancelling
You can manage your subscription and turn off auto-renewal at any time in the Settings app on your device, under your Apple ID and then Subscriptions. Cancellation takes effect at the end of the current billing period; you keep access until then. Deleting the App does not cancel a subscription.
4.5 Refunds
Refunds for App Store purchases are handled by Apple in accordance with Apple’s policies, and requests should be directed to Apple. If you are a consumer in the European Union, you may also have a statutory right of withdrawal within 14 days of purchase under applicable consumer law; note that this right may be lost once you begin using digital content you have expressly requested immediate access to. Nothing in these Terms limits any statutory consumer right you have that cannot be waived by agreement.
4.6 Price changes
We may change subscription prices or plans. Any price increase applies only to future billing periods and will be communicated to you in advance in accordance with Apple’s requirements. You may cancel before the change takes effect.
4.7 Parental consent for purchases
Purchase screens in the App are placed behind a parental gate. By allowing a child to use the App on your device, you remain responsible for purchases made through your Apple ID. We recommend enabling Apple’s Screen Time and Ask to Buy or purchase-password settings.
5. Educational purpose
Not a medical device
Pippo Phonics is an educational product intended to support the development of phonics and early literacy skills through practice. It does not diagnose, treat, cure, or prevent any condition, including any speech, language, hearing, or learning disorder, and it is not a substitute for assessment or therapy by a qualified speech-language pathologist, physician, teacher, or other professional.
The App has been developed with input from qualified professionals and is grounded in evidence-based practice, but individual results vary. If you have concerns about a child’s speech, language, hearing, or learning development, consult a qualified professional.
6. Microphone and speech
Core activities require microphone access so that spoken responses can be recognised. Speech is processed on the device by our own speech recognition engine.
Speech recognition is a probabilistic technology. It may occasionally accept an inaccurate response or reject a correct one, and performance can vary with background noise, microphone quality, accent, and individual speech patterns. The App is currently optimised for English.
Our handling of speech input, and the separate optional program for contributing anonymized recordings, is described in our Privacy Policy, which forms part of these Terms.
7. Availability and changes
We may update, modify, suspend, or discontinue the App or any of its features at any time. We will make reasonable efforts to avoid disrupting active subscriptions, and where a discontinuation materially affects a paid subscription, we will handle it in accordance with applicable consumer law and Apple’s policies.
Most activities work offline, but some features may require an internet connection.
8. Disclaimer of warranties
To the maximum extent permitted by applicable law, the App is provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components, or that defects will be corrected.
Some jurisdictions do not allow the exclusion of certain warranties. Where that is the case, the exclusions above apply only to the extent permitted, and your mandatory statutory rights as a consumer are unaffected.
9. Limitation of liability
To the maximum extent permitted by applicable law, SAY IT Labs will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of or inability to use the App.
To the maximum extent permitted by applicable law, our total aggregate liability arising out of or relating to the App or these Terms will not exceed the greater of (a) the amount you paid to access the App in the twelve months preceding the event giving rise to the claim, or (b) fifty euros (€50).
Your statutory rights stand
Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law. If you are a consumer, your mandatory statutory rights are unaffected.
10. Indemnity
You agree to indemnify and hold harmless SAY IT Labs and its officers, employees, and agents from any claims, damages, and reasonable costs arising out of your breach of these Terms or your misuse of the App, except to the extent caused by our own acts or omissions. This clause does not apply where it would be unenforceable against you as a consumer under applicable law.
11. Privacy
Our collection and handling of information is described in the Privacy Policy at pippophonics.com/privacy-policy, which is incorporated into these Terms by reference. Because Pippo Phonics is intended for children, the Privacy Policy explains in detail what the App does and does not collect.
12. Termination
These Terms apply until terminated. Your license terminates automatically if you breach any of its terms, and you may terminate at any time by deleting the App from your device. Termination does not entitle you to a refund of amounts already paid, except where required by applicable law. Sections 3, 5, 8, 9, 10, and 14 survive termination.
13. Apple-specific terms
The following terms apply because the App is distributed through the Apple App Store:

These Terms are between you and SAY IT Labs only, not with Apple. SAY IT Labs, not Apple, is solely responsible for the App and its content.

Apple has no obligation whatsoever to furnish any maintenance or support services for the App.

In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are the sole responsibility of SAY IT Labs.

Apple is not responsible for addressing any claims by you or any third party relating to the App or your possession and use of it, including product liability claims, any claim that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.

In the event of any third-party claim that the App or your possession and use of it infringes intellectual property rights, SAY IT Labs, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of that claim.

You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

14. Governing law
These Terms are governed by the laws of Belgium, without regard to conflict-of-law rules. If you are a consumer, this choice of law does not deprive you of the protection of mandatory provisions of the law of your country of residence.
Disputes will be subject to the competent courts of Belgium, except that consumers may also bring proceedings in the courts of their own country of residence where applicable law so provides. Consumers in the European Union may also use the European Commission’s Online Dispute Resolution platform.
15. Changes to these terms
We may update these Terms. The “Last updated” date above will reflect the most recent version. Material changes will be communicated in the App or through the App Store listing where required. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
16. General
If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. Our failure to enforce any right is not a waiver of it. These Terms, together with the Privacy Policy, constitute the entire agreement between you and SAY IT Labs regarding the App.
